O1 zone, Burlington: O1 Zone (Open Space)

By-law 2020 Part 10, Sections 1 and 4 (4.1 to 4.5) of the City of Burlington Zoning By-law 09-2026 / 2020.

The O1 zone covers parks, public and private open space, golf courses and cemeteries, with buildings kept well back from streets and neighbouring homes.

Standards

Minimum front yard15 ms.4.4(a): yard abutting a street 15 m; abutting a residential zone 15 m; abutting any other lot line 7.5 m. Yards are set by what the lot line abuts, not by front/rear/side.
Minimum interior side yard7.5 ms.4.4(a): 7.5 m abutting any other lot line; 15 m if the lot line abuts a residential zone.
Minimum exterior side yard15 ms.4.4(a): 15 m abutting a street.
Minimum rear yard7.5 ms.4.4(a): 7.5 m abutting any other lot line; 15 m if the lot line abuts a residential zone or a street.

Other provisions in this section

  • s.1: all Part 10 zones are subject to Part 1 (General Conditions and Provisions) and Part 14 (Exceptions to Zone Designations).
  • s.4.3: buildings and structures intended for public assembly must be set back 30 m from a railway right-of-way.
  • s.4.4(b): minimum landscape area 6 m abutting a street and 9 m abutting a creek block (linear widths, not a percentage of lot).
  • s.4.4(c): minimum landscape buffer 9 m abutting a residential zone.
  • s.4.4(d): a crematory is not permitted within 70 m of the boundary of a Residential, Downtown, MXG or MXC zone.
  • s.4.5: for lands north of Highway 403 and west of Kerns Road, golf course and associated uses (curling club, tennis club, arena, gymnasium, swimming pool) and crematory are prohibited.
  • s.4.5(b): for lands north of Highway 403 and west of Kerns Road, maximum impervious surface cover per lot is 40%.
  • Outdoor patio permitted only subject to Part 1, Section 2.21, Subsection (v).
