What the C5 zone permits

  • Automobile service station or gas bar (s.3.3.3.1(b)(vii))
  • A use permitted in all zones under s.2.1.1 (s.3.3.3.1(d)(xiv))
  • A use, building or structure accessory to a permitted use (s.3.3.3.1(d)(xv))
  • Accessory to an automobile service station: keeping licensed trailers for hire or lease, and sale of used motor vehicles, subject to s.3.3.3.2; not more than 50% of the parking spaces required by s.2.2.1.2(b)(ii)(10) may be used to store or park them (s.2.1.11.3, by-law p.52, PDF p.70; the proviso is missing from the PDF text layer). In the 2012 consolidation item (10) is the rollover car wash rate; the automobile service station or gas bar rate is item (12) (PDF p.85), so the cross-reference appears stale.

Standards

RequirementBy-law
Minimum lot area (interior lot)900 m²
Minimum lot width (interior lot)30 m
Minimum front yard15 ms.3.3.3.2 Site Development Specifications Applicable in C-Class Zones (PDF pp.134-135, by-law pp.116-117) row (c)(i): buildings 15 m; row (c)(ii)-(iv): fuel pump, dispenser island and kiosk on the island (kiosk max 10 m2) 6 m; weather canopy 3 m. Designated-road setbacks of s.2.1.19 (PDF pp.75-79) may increase this.
Minimum interior side yard3 ms.3.3.3.2 Site Development Specifications Applicable in C-Class Zones (PDF pp.134-135, by-law pp.116-117) row (e): 3 m; row (g): 7.5 m where abutting a residential zone.
Minimum exterior side yard15 ms.3.3.3.2 Site Development Specifications Applicable in C-Class Zones (PDF pp.134-135, by-law pp.116-117) row (f)(i): buildings 15 m; row (f)(ii)-(iv): fuel pump, dispenser island and kiosk on the island (kiosk max 10 m2) 6 m; weather canopy 3 m. Designated-road setbacks of s.2.1.19 may increase this.
Minimum rear yard3 ms.3.3.3.2 Site Development Specifications Applicable in C-Class Zones (PDF pp.134-135, by-law pp.116-117) row (d): 3 m; row (g): 7.5 m where the rear yard abuts a residential zone.
Maximum building heightSee noteNo height limit in the zone itself: the zone's standards table, s.3.3.3.2 (PDF pp.134-135), has no maximum height row. The C table row (i) (s.3.3.3.2, PDF p.135) refers to s.2.1.9 for a minimum height only: 6 m for new buildings in the shaded core areas of Maps Z4-Z6 (s.2.1.9.1). Two map-based general rules can still cap height, depending on where the lot is: (1) s.2.1.9.2 (PDF p.67, by-law p.49, By-law 161-07): in the Galt City Centre Core Area, Map Z7 sets 15 m (Area A), 21 m (B), 28 m (C) or 34 m (D) above finished grade, not counting rooftop mechanical, electrical or elevator equipment or chimneys; (2) s.2.1.10 (PDF pp.67-68): near Waterloo Regional Airport, Map Z1 caps the highest point of any building at 326, 341.5, 352 or 360 m above sea level (Canadian Geodetic Datum) in Areas A-D. That is an elevation, not a height above grade. Neither map is in the text, so a lookup should show 'no zone height limit' and ask whether the lot is on Map Z7 or Map Z1. Site-specific exceptions in section 4 may also set a height.
Maximum lot coverage25 %s.3.3.3.2 Site Development Specifications Applicable in C-Class Zones (PDF pp.134-135, by-law pp.116-117) row (h): 25% of lot area, excluding the pump island and weather canopy.
Maximum floor space indexSee noteNo floor space index or floor area ratio is set for this zone in by-law 150-85 s.3.3.3.2.

Other provisions in this section

(The text layer of PDF p.67 is missing s.2.1.8.2; read from the page image.)
  • Compound zones (s.2.1.3, PDF pp.62-63): where two zone symbols apply (e.g. C1RM1), land may be used for any use permitted in either zone or a combination; where C5 is combined with another zone, the C5 yard and frontage/area rules (s.3.3.3.2(b), (c)(ii)-(iii), (f)(ii)-(iii)) apply to the service station/gas bar; in a commercial/residential mixed-use building the residential site rules of s.3.1.2 apply if residential gross floor area exceeds two-thirds of the building, otherwise the commercial rules of s.3.3.3.2/3.3.3.3 apply; parking and loading must be provided for every use.
