  • Minimum height: n/a (row 11.0).
  • Maximum setback rows 6.1-6.3 and rows 13.0 and 14.0 are deleted (0121-2020/LPAT Order 2021 March 11); row 8.0 is deleted (0191-2009/OMB Order 2010 May 05).
  • Subsection 2.1.17 / Table 2.1.17.1 (note 5): all buildings and structures, and all parking areas, driveways, loading spaces, other paved areas and outdoor storage areas, must be set back the greater of 5.0 m or the required yard/setback from lands zoned G1 or G2 Base Zone (buildings: also G1 Exception Zones).
  • Minimum landscaped buffer (row 12, note 11: see also Subsection 2.1.25): 7.0 m from a lot line abutting a Residential Zone; 4.5 m from a street line; 3.0 m from a lot line abutting an Institutional, Office, Commercial, Downtown Core, Parkway Belt or Buffer Zone; 0.0 m from a lot line abutting an Employment, Utility or Airport Zone; 4.5 m from any other lot line.
  • Subsection 2.1.25: landscaped buffer may be reduced to 0.0 m abutting a sight triangle (or a 0.3 m reserve abutting one) (2.1.25.1), and is not required along the portion of a shared property line where a driveway, condominium road, aisle or parking area is shared with abutting lands (2.1.25.2). The 3.0 m street-line reduction in 2.1.25.3 applies only to E2 and E3, not E1.
  • Article 8.2.1.3: in an E1 zone a one-storey free-standing building or structure used for a financial institution is not permitted within 100.0 m of Hurontario Street (0191-2009/OMB Order 2010 May 05), (0018-2021).
  • Articles 8.2.1.1 and 8.2.1.2 (railway spur line yard exemptions) apply only to E2 and E3, not E1.
  • Subsection 8.1.1: unless otherwise permitted, all uses in an E1 zone must be located wholly within a building, structure or part thereof; all uses pertaining to cannabis production must be wholly within a building (8.1.1.1); a seasonal or permanent outdoor patio is permitted accessory to a restaurant, convenience restaurant or take-out restaurant where those uses are permitted, subject to Articles 2.1.9.14 and 2.1.9.16 (8.1.1.2).
  • Subsection 8.1.2 (Accessory Uses in Employment Zones): an accessory use is only permitted accessory to an office building or medical office building and must be contained wholly within that building (8.1.2.1); permitted accessory uses are laboratories and associated facilities for medical diagnostic and dental purposes, medical supply and equipment store, pharmacy, motor vehicle rental facility, retail store less than 600 m2 and a service establishment; in an E1 zone also a restaurant and take-out restaurant, and a day care (8.1.2.1.1); a maximum of 20% of the total gross floor area - non-residential of the office building or medical office building may be used for accessory uses (8.1.2.1.2).
  • Article 8.1.2.1.3: an accessory day care is only permitted in an E1 or E2 zone, subject to Subsection 2.1.23 (Pearson Airport Operating Area restrictions).
  • Article 8.1.3.1: in an E1 zone a maximum of 20% of the total gross floor area - non-residential of a Business Activity use (Table 8.2.1) may be used for accessory retail sales, leasing and/or rental, accessory retail display and/or installation of products other than motor vehicles, provided (1) the products are those manufactured within a manufacturing facility, repaired within a repair establishment, wholesaled within a wholesaling facility, or distributed from a warehouse/distribution facility; (2) the area is wholly within an enclosed building; (3) the area is within the same unit as the principal permitted use; (4) condition (1) does not apply to recreational cannabis producers, whose accessory retail is limited to products purchased from the Ontario Cannabis Store. The accessory retail sales/display area must be separated from the rest of the facility by a permanent, solid, floor-to-ceiling and wall-to-wall partition and closed doors (8.1.3.1.1).
  • All buildings and structures must also comply with Parts 1 to 3 and Section 8.1 of the By-law.
  • Site-specific exception zones E1-1 to E1-30 exist (Section 8.2.2; see Article 1.1.2.3).
