Section 10.2 (10.2.1 Permitted Uses, 10.2.2 Prohibited Uses, 10.2.3 Regulations, 10.2.4-10.2.7) of the City of Hamilton Zoning By-law 05-200, as amended by 17-240, 19-062, 21-189, 24-137, 25-155.

A small-scale commercial zone for shops, offices, restaurants and services that serve the surrounding neighbourhood, with apartments allowed above the ground floor, on lots up to 5,000 m² along collector or arterial roads.

  • Maximum lot area: 5,000.0 m² (10.2.3 e)).
  • Prohibited uses, even as accessory uses: Commercial Parking Facility and Drive-Through Facility (10.2.2).
  • Emergency Shelter: maximum capacity 6 residents; minimum 300 m radial separation (lot line to lot line) from any other lot occupied by an Emergency Shelter; an existing shelter within 300 m of another may be expanded or redeveloped only up to the permitted number of residents (10.2.1.1 i)).
  • Dwelling Unit(s), Mixed Use permitted only above the ground floor (except access, accessory office and utility areas) and may not occupy more than 50% of the total gross floor area of all buildings on the lot; this does not apply to buildings existing at the passing of the by-law where the ground floor contains a commercial use and the minimum building height is 9.0 m; dwelling units are also permitted in a basement or cellar (10.2.1.1 ii)).
  • Built form for new buildings/additions (10.2.3 i)): rooftop mechanical equipment must be located and/or screened from view of any abutting street; on an interior or through lot the ground-floor facade facing the front lot line must be at least 40% of the front lot line length; on a corner lot the combined ground-floor facade facing street lines must be at least 50% of all lot lines abutting a street; facade width excludes access driveways and required yards; for commercial development existing at passing of the by-law, new commercial buildings under 650 m² GFA are permitted notwithstanding the facade rules.
  • No parking, driveways, stacking lanes or aisles between a building facade and the front lot line or flankage lot line (10.2.3 i) vi)).
  • At least one principal entrance within the ground-floor facade set back closest to a street, accessible directly from the public sidewalk (10.2.3 i) vii)); a walkway is permitted in a required Planting Strip.
  • Properties designated under the Ontario Heritage Act: alternative building design or materials approved by a Heritage Permit are deemed to comply with Section 10.2.3 (10.2.3 i) ix)).
  • Planting Strip: minimum 1.5 m wide where a lot line abuts a Residential or Institutional Zone lot line (not a laneway) (10.2.3 j)); motor vehicle service stations require a minimum 3.0 m planting strip abutting any street line or Residential/Institutional Zone lot line except at ingress/egress points (10.2.4 c)).
  • Visual barrier required along any lot line abutting a Residential, Institutional, Downtown (D5) or Downtown (D6) Zone, per Section 4.19 (10.2.3 k)).
  • No outdoor storage of goods, materials or equipment; display of goods for retail accessory to a retail use permitted only in a front or flankage yard (10.2.3 l)).
  • Motor Vehicle Service Station: minimum yard abutting a street 4.5 m; fuel pump islands, fuel pumps and canopies minimum 4.5 m from any lot line; accessory retail maximum 175 m² GFA (10.2.4).
  • Legally existing single detached and duplex dwellings (as of November 8, 2017): additions or alterations increasing interior volume/size permitted up to 10% of the existing GFA, the 3.0 m maximum street setback does not apply, and existing side yard setbacks must be maintained (10.2.5; also Section 4.12 f)).
  • Accessory buildings per Section 4.8 (10.2.6); parking per Section 5 (10.2.7).
