Section 11.2 (Subsections 11.2.1 to 11.2.7; regulations in 11.2.3) of the City of Hamilton Zoning By-law 05-200, as amended by 16-265, 18-032, 18-219, 19-062, 21-189, 24-137, 25-155.

A zone along major transit roads meant for the shops, restaurants, offices, clinics and services that serve the local neighbourhood, with apartments allowed above the ground floor but no houses or drive-throughs.

Other provisions in this section

  • Restricted use: a Dwelling Unit, Mixed Use is permitted only above the ground floor (11.2.1.1, By-law 21-189).
  • Prohibited uses, even as accessory uses (11.2.2 i): Commercial Driving School, Drive-Through Facility, Duplex Dwelling, Motor Vehicle Dealership, Motor Vehicle Gas Bar, Motor Vehicle Rental Establishment, Motor Vehicle Service Station, Motor Vehicle Washing Establishment, Semi-Detached Dwelling, Single Detached Dwelling, Street Townhouse.
  • Garden Centre is prohibited unless it is an accessory use to another permitted use (11.2.2 ii).
  • Maximum total gross floor area for an individual Office and Medical Clinic: 500.0 m2 per unit (11.2.3 e).
  • Maximum total gross floor area for commercial uses per lot: 10,000.0 m2 (11.2.3 f).
  • Screening: rooftop mechanical equipment must be located and/or screened from view of any abutting street (11.2.3 g).
  • Visual barrier required along any lot line abutting a Downtown D5 Zone, Institutional Zone or Residential Zone, per Section 4.19 (11.2.3 h).
  • Outdoor storage of goods, materials or equipment is not permitted; display of goods for retail purposes accessory to a retail use is permitted only in the front yard or flankage yard (11.2.3 i).
  • Accessory buildings: in accordance with Section 4.8 (11.2.4).
  • Parking: in accordance with Section 5 (11.2.5).
  • Urban Farmers Market: in accordance with Section 4.28 (11.2.6).
  • Community Gardens as accessory use: per Section 4.27, and only in the rear yard or on the roof-top of the principal building (11.2.7 a, By-law 24-137).
  • Urban Farm as accessory use: per Subsection 4.26 (c), and only in the rear yard or on the roof-top of the principal building (11.2.7 b, By-law 24-137).
