Other provisions in this section

  • General: all buildings and structures must also comply with Parts 1 to 3 and Section 7.1 of the By-law (Section 7.2.1).
  • Minimum height: 3 storeys (Line 4B.1).
  • Minimum gross floor area for an apartment zone: 1.0 times the lot area (Line 3.1).
  • Maximum tower floor plate for an apartment: 850 m² (Line 3.2).
  • Residential dwelling units (apartment, long-term care, retirement) are not permitted on the first storey of a building; a shared entrance/exit through a common vestibule is permitted on the first storey (Line 3.3).
  • Build-to-areas: each building, structure and/or use must comply with the build-to-area regulations shown on the Schedules and Exception Schedules in Part 7 (Line 4.1); where a property has build-to-areas along more than two lot lines, the building must be located along a minimum of two build-to-areas (Line 4.2). Line 4.3 deleted by 0050-2013/LPAT Order 2020 June 08.
  • 'A' and 'B' Street Frontages (Lines 4A.1-4A.11): a building with a streetwall facing an 'A' or 'B' Street Frontage on the Part 7 Schedules must comply with Lines 4A.2 to 4A.11.
  • Glazing: minimum 65% of the area of the first storey streetwall of a building containing a non-residential use facing an 'A' Street Frontage must be glazing (clear or transparent glass) (Line 4A.2); minimum 50% facing a 'B' Street Frontage (Line 4A.3).
  • Pedestrian access: each unit with a first storey streetwall facing an 'A' Street Frontage (or both 'A' and 'B') must have a main front entrance facing the 'A' Street Frontage, and access to units above/below the first storey must be through a main front entrance facing the 'A' Street Frontage (Lines 4A.4-4A.7); units facing only a 'B' Street Frontage must have a main front entrance facing the 'B' Street Frontage (Lines 4A.8-4A.9).
  • Vehicular access to a building with a first storey streetwall facing both 'A' and 'B' Street Frontages must be from the 'B' Street Frontage (Line 4A.10).
  • An above-grade or partially above-grade parking structure shall not face a street with an 'A' Street Frontage (Line 4A.11).
  • Podiums: apartment, long-term care and retirement buildings greater than 12 storeys must contain a podium (Line 4C.1); minimum podium height measured at the streetwall is three storeys (Line 4C.2).
  • The first three storeys of a podium in a residential building shall not project beyond or behind the first storey of the streetwall (Line 5.1). Lines 5.2 (minimum setback above the podium) and 5.3 (maximum encroachment into that setback) have no value printed in the CC3 column.
  • An at-grade driveway, aisle, parking area or loading area is not permitted between a building wall and a lot line abutting a street, or within 7.6 m of a lot line abutting a street, except for vehicular accesses; where a lot abuts more than two streets, an at-grade driveway, aisle or parking area is not permitted between the building wall and the lot lines abutting two of the streets (Line 6.1).
  • Driveways, condominium roads and aisles may be shared with abutting lands having the same zoning (Line 6.2).
  • Line 7.1 Minimum Landscaped Open Space Area: no value printed for CC3. Line 8.1 (Exemptions) deleted by 0050-2013/LPAT Order 2020 June 08.
  • Uses not permitted in Areas 'A', 'B' and 'C' on Schedules CC3(1) to CC3(3): banquet hall/conference centre/convention centre, overnight accommodation, restaurant, take-out restaurant, entertainment establishment (Subsection 7.1.2.1).
  • Townhouse and street townhouse are only permitted within Areas 'A' and 'B' on Schedules CC3(1) to CC3(3) (Subsection 7.1.3.1, 0181-2018/LPAT Order 2019 February 15).
  • Accessory uses (Subsection 7.1.4.2): financial institution, service establishment, repair establishment, recreational establishment, restaurant, take-out restaurant, retail store, entertainment establishment, motor vehicle rental facility, cogeneration facility, and an outdoor patio accessory to a retail store primarily selling food are permitted accessory to an office building, medical office building, apartment, long-term care building, retirement building, overnight accommodation, banquet hall/conference centre/convention centre, hospital, university/college, staff/student residence, parking structure or centre for the performing arts (except as restricted by 7.1.2.1); they must be located within such a building (7.1.4.2.3) and are not permitted above the second storey (7.1.4.2.4); a motor vehicle rental facility shall not store rental vehicles in required parking spaces (7.1.4.2.5).
  • Long-term care buildings: two long-term care beds equal one dwelling unit for the purpose of counting dwelling units (Subsection 7.1.6, 0174-2017).
  • Centreline setbacks in Subsection 2.1.14 do not apply to the CC1 to CC4 and CCO zones (Subsection 7.1.8.1).
  • Holding provision (H-CC3): the H symbol is removed by amendment to Maps 22, 28 and 29 of Schedule B upon (1.1) delivery of an executed Servicing and/or Development Agreement covering municipal works, walkways, road-widening dedications, transit rights-of-way/easements, parkland and securities, and (1.2) conveyance of a right-of-way for a street on 'A' and 'B' Street Frontages where a street does not exist; the H symbol does not prevent use of legally existing buildings for permitted uses, nor alterations that do not increase gross floor area - non-residential or add required parking.
  • Definitions for Part 7: Glazing means clear or transparent glass; Podium means the base of a building at or above established grade projecting from the tower portion; Height of a Podium is the vertical distance from established grade to the highest point of the podium roof surface.
