Other provisions in this section
- Minimum building setback of 15.0 m from a lot line abutting a lot in the Residential or Residential Apartment zone category; non-building structures also no closer than 15.0 m (60.40.40.70(4)).
- Lawfully existing lots with less than the 30.0 m minimum frontage keep their lawful frontage as the minimum; additions must comply with all other regulations or obtain a Section 45 minor variance (60.40.30.21).
- Lawfully existing buildings taller than the maximum height, or with smaller setbacks, keep their lawful height/setbacks; additions must comply with max height, and may match the existing main-wall setbacks, or obtain a Section 45 minor variance (60.40.40.11, 60.40.40.71).
- Soft landscaping: any lot line abutting a street needs a minimum 3.0 m wide strip of soft landscaping along its entire length, excluding driveways and walkways (60.40.50.10).
- Ancillary buildings and structures must comply with the requirements for a building or structure (60.40.60.1).
- Gatehouse, scale, weigh-house, fire pump house or other security building is permitted in the front yard and is exempt from minimum front, side and rear yard setbacks (60.40.60.10).
- A parking space not in a building must be at least 0.5 m from a lot line (60.40.80.20).
- Loading spaces may not be in a front yard, a side yard abutting a street, or a side/rear yard abutting a Residential or Residential Apartment zone lot; lawfully existing non-complying loading spaces are exempt (60.40.90.10, 60.40.90.11).
- Loading space access: from the lane if the lot abuts a lane; for a corner lot without a lane, from the street that is not a major street; otherwise from the fronting street. No loading access through a main wall facing a street. Lawfully existing access is exempt (60.40.90.40, 60.40.90.41).
- Separating or sorting of recyclable materials must take place within a wholly enclosed building (60.40.20.1).
- Condition (1): total interior floor area of all eating establishments and take-out eating establishments on a lot may not exceed 500.0 m2.
- Condition (2): a contractor's establishment may not store heavy equipment (cranes, ploughs, tractors, pile drivers, road making, wrecker's or steel erector's equipment).
- Condition (3): interior floor area of the listed manufacturing uses on a lot is limited to the lesser of 5,000 m2 or the max FSI given by the 'e' value in the zone label.
- Conditions (5), (7), (10): a hotel, recreation use, or drive through facility must be on a lot fronting a major street on the Policy Areas Overlay Map.
- Condition (6): total interior floor area of retail services, retail stores or personal service shops on a lot may not exceed the greater of 300.0 m2 or 10% of the gross floor area of buildings on the lot, to a maximum of 500.0 m2.
- Condition (8): public parking abutting a Residential/Residential Apartment zone lot: no vehicle access over the residential lot, abutting lot line must be fenced, and parking/storage areas at least 3.0 m from that lot line.
- Condition (9): one parking attendant shelter permitted with public parking: max height 4.0 m including mechanical equipment, max interior floor area 5.0 m2, at least 6.0 m from a lot line abutting a street.
- Condition (11): a place of assembly must be on a lot whose zone symbol has an 'o' value of 1.5 or greater.
- Condition (13): open storage must be associated with a permitted use, not in a yard abutting a Residential/Residential Apartment zone lot, not in the front yard, at least 7.5 m from any lot line, no more than 10% of lot area, no higher than the permitted max building height, enclosed by a fence; may be for recyclable material and waste.
- Condition (14): outdoor patio must be combined with a permitted use on the same or abutting lot; no closer to a lot line than the required rear or side yard setback; not on land required for loading, driveways or landscaping; max area the greater of 50.0 m2 or 50% of the interior floor area of the premises; entertainment allowed only on lots abutting a major street, not above the first storey, entertainment area max the greater of 10% of patio area or 5.0 m2; at least 30.0 m from a Residential/Residential Apartment zone lot (40.0 m if above the first storey); fence required along rear-lot-line portion when in a rear yard abutting such a lot; lawfully existing closer patios keep their lawful distance.
- Conditions (16), (18), (21), (29): eating establishments must comply with Section 150.100; drive through facilities with Section 150.80; vehicle fuel stations with Section 150.92; places of worship with Section 150.50 (place of worship provisions under OLT appeal, not in full force).
- Condition (19): a banquet hall with interior floor area greater than 1,000 m2 must be at least 300 m from a Residential/Residential Apartment zone lot, unless combined with a hotel.
- Condition (20): an eating establishment or take-out eating establishment with interior floor area of at least 130 m2 may have a maximum of 2 amusement devices.
- Condition (23): a retail store on a lot with a manufacturing use must be associated with that manufacturing use, and total retail store interior floor area may not exceed 20% of the gross floor area of the manufacturing use.
- Condition (24): renewable energy or cogeneration energy production must be combined with another permitted use on the lot and comply with all municipal, provincial and federal laws.
- Condition (25): a public utility may not be a sewage treatment plant.
- Condition (26): a building used as a transportation use must comply with all requirements for a building on that lot.
- Condition (27): a hydro electrical transformer station or natural gas regulator station must be enclosed by walls and comply with max lot coverage, min building setbacks and max height for a building.
- Condition (28): a retail store with a vehicle fuel station must be a convenience store; interior floor area of the fuel station, retail store, eating establishment or take-out eating establishment may not exceed 300 m2; the store may remain only while the fuel station exists.
- Condition (30) (under OLT appeal): a place of worship may not exceed 5,000 m2 interior floor area and must be on a lot with a front or side lot line abutting a major street on the Policy Area Overlay Map.
- Lot coverage, minimum lot area and other category-wide standards are not stated in Section 60.40; see Section 60.5, Chapter 5 and the zoning map/overlay attributes (f, a, d, u suffixes and HT/coverage overlays).
