The IE zone is for colleges, universities and related institutional uses such as libraries, museums, places of assembly and student residences, with building size and placement mostly governed by overlay maps and a setback equal to half the building height.

Other provisions in this section

  • Regulations in Section 80.30 apply to all lands, uses, buildings and structures in the IE zone (80.30.1.10(1)); category-wide rules are in Section 80.5 and Chapter 5.
  • Separation between buildings: if two or more buildings are on a lot, minimum separation between main walls is the greater of 20 m or half the total height of the two buildings (80.30.40.80(1)).
  • Public parking attendant shelter: one building permitted on a lot with public parking, max height 4.0 m including mechanical equipment, max interior floor area 5.0 m2, at least 6.0 m from a lot line abutting a street (80.30.20.100(1)).
  • Software development and processing must be operated by or in association with a post-secondary school (80.30.20.100(2)).
  • Office or medical office must be in association with a post-secondary school on the lot (80.30.20.100(3)).
  • Eating establishment / take-out eating establishment interior floor area may not exceed 1000 m2; does not apply to a cafeteria ancillary to a post-secondary school (80.30.20.100(4), By-law 1092-2021).
  • Financial institution interior floor area max 500 m2 (80.30.20.100(5)).
  • Personal service shop interior floor area max 500 m2 (80.30.20.100(6)).
  • Place of assembly, entertainment place of assembly or sports place of assembly must be operated by or in association with a post-secondary school (80.30.20.100(7)).
  • Retail store interior floor area max 500 m2 (80.30.20.100(8)).
  • Day nursery interior floor area max 500 m2 (80.30.20.100(9)).
  • Community centre max 5000 m2 gross floor area (80.30.20.100(10)).
  • Laboratory must be operated by or in association with a post-secondary school (80.30.20.100(11)).
  • Public parking: vehicle access may not be over any part of a lot in the Residential Zone category (80.30.20.100(12)).
  • If the lot is within 6.1 m of a lot in the Residential Zone category, total interior floor area of all eating establishments and take-out eating establishments on the lot may not exceed 400 m2 (80.30.20.100(13)).
  • Ambulance depot, fire hall and police station must be on a lot fronting a major street on the Policy Areas Overlay Map, or fronting a street that intersects a major street and no more than 250 m from that intersection (80.30.20.100(14),(15),(16)).
  • Public utility may not be a sewage treatment plant, water filtration plant or above-ground water reservoir (80.30.20.100(17)).
  • A hydro electrical transformer station or natural gas regulator station public utility must be enclosed by walls and comply with the IE zone max lot coverage, min building setbacks and max height (80.30.20.100(18)).
  • Transportation use building or structure must comply with all requirements for a building on that lot (80.30.20.100(19)).
  • Renewable energy or cogeneration energy production must be in combination with another permitted use on the lot and comply with all Municipal, Provincial and Federal by-laws, statutes and regulations (80.30.20.100(20)).
  • Secondary suite must comply with specific use regulations in Section 150.10 (80.30.20.100(22)).
  • Place of worship must comply with specific use regulations in Section 150.50 (80.30.20.100(23)); this clause is under appeal to the OLT and not in full force and effect.
  • Surface parking space may not be in a front yard (80.30.80.10(1)).
  • Parking space not in a building or structure must be at least 0.5 m from a lot line (80.30.80.20(1)).
  • Loading space may not be in a front yard, a side yard abutting a street, or any yard abutting a lot in the Residential Zone or Residential Apartment Zone category (80.30.90.10(1)); a lawful existing non-complying loading space in a lawfully existing building is exempt (80.30.90.11(1)).
  • Waste: all waste and recyclables must be stored in a wholly enclosed building if the building permit was issued more than three years after May 9, 2013; an ancillary waste building may not be in a front yard or side yard abutting a street and must be at least 7.5 m from a lot in the Residential, Residential Apartment or Open Space Zone category and 1.0 m from all other side lot lines and the rear lot line (80.30.150.1(1)).
  • Lot frontage, lot area, FSI and unit count may be set by numeric suffixes on the zone label (f, a, d, u) on the Zoning By-law Map; height (HT) and lot coverage overlay maps override the defaults.
