OC zone, Toronto: Open Space - Cemetery Zone

Section 90.70 (Chapter 90 Open Space) of the City of Toronto Zoning By-law 569-2013.

A zone for cemeteries and related facilities such as funeral visitation centres, mausoleums and columbaria, where buildings must be low (generally 15 m or less) and set well back from all lot lines.

Other provisions in this section

  • All of Section 90.70 was enacted May 9, 2013 but is under appeal to the OLT and not in full force and effect (shaded yellow in the office consolidation).
  • Category-wide regulations for Open Space zones are in Section 90.5; regulations for all zones in Chapter 5; definitions in Chapter 800.
  • Cogeneration energy production or renewable energy production must be combined with another permitted use on the lot and comply with all municipal, provincial and federal laws (90.70.20.100(1)).
  • A funeral visitation centre must be combined with a cemetery (90.70.20.100(2)).
  • An office or retail store must be in association with a cemetery or a funeral visitation centre (90.70.20.100(3)).
  • Monuments 3.0 m or less in height: minimum front, rear and side yard setback is 0.9 m instead of the general setback (90.70.40.70(1)(C)).
  • Columbarium or mausoleum separation from a lot in the Residential or Residential Apartment Zone category: at least 7.5 m if its height is 2.0 m or less and volume 15.0 m3 or less; otherwise at least 30.0 m (90.70.40.80(1)).
  • Columbarium or mausoleum separation from a lot not in the Residential or Residential Apartment Zone category: the greater of 7.5 m or a distance equal to its height (90.70.40.80(2)).
  • A lawfully existing columbarium or mausoleum with less than the required separation may keep its existing lawful separation distance as its minimum (90.70.40.81(1)).
  • Any addition or extension to such a lawfully existing columbarium or mausoleum must meet the required minimum separation or obtain a Section 45 Planning Act minor variance (90.70.40.81(2)).
  • Lot frontage, lot area, FSI, unit count and lot coverage values may also be carried as suffixes on the zone label / overlay maps (ZN_FRONTAGE, ZN_AREA, ZN_FSI_DENSITY, ZN_UNIT_COUNT, ZN_COVERAGE); the Height Overlay Map (HT) governs height where a value is shown.
