Chapter 90, Section 90.50 of the City of Toronto Zoning By-law 569-2013, as amended by 1153-2023.

A waterfront open-space zone for marinas, parks and related public and recreational uses, with low-density buildings kept well back from neighbouring properties.

Standards

Other provisions in this section

  • Amusement arcade must be combined with a park or marina and may have no more than 12 amusement devices (90.50.20.100(1)).
  • Club, eating establishment, education use, place of assembly or recreation use must be combined with a park or marina (90.50.20.100(2)).
  • Cogeneration or renewable energy production must be combined with another permitted use on the lot and comply with all municipal, provincial and federal laws (90.50.20.100(3)).
  • Outdoor patio must be combined with an amusement arcade, club, place of assembly, recreation use or take-out eating establishment on the same or an abutting lot that permits an outdoor patio (90.50.20.100(4)(A)).
  • Outdoor patio must be at least 10.0 m from a lot in a Residential or Residential Apartment Zone category; 40.0 m (measured horizontally) if the patio is above the first storey (90.50.20.100(4)(B),(C)).
  • A lawfully existing outdoor patio closer than 10.0 m / 40.0 m keeps its existing lawful distance as its minimum (90.50.20.100(4)(D)).
  • Outdoor patio may provide entertainment (performances, music, dancing) only if not above the first storey and the entertainment area does not exceed the greater of 10 percent of the patio area or 5.0 m2 (90.50.20.100(4)(E), By-law 1153-2023).
  • Personal service shop, retail store, service shop or take-out eating establishment must be combined with a park or marina and have an interior floor area no greater than 500 m2 (90.50.20.100(5)).
  • Maximum height is the 'HT' value on the Height Overlay Map, or 15.0 m where no HT value applies (90.50.40.10).
  • Minimum building setback from front, rear and side lot lines is the greater of 7.5 m or the building/structure height; no setback required from a lot line at the shoreline of or in Lake Ontario (90.50.40.70).
  • Category-wide regulations in Section 90.5 and Chapter 5 also apply; lot frontage/area/FSI/unit-count suffixes and Height/Lot Coverage overlays are carried on the zoning map labels.
