TOC1 zone, Hamilton: Transit Oriented Corridor Mixed Use Medium Density (TOC1) Zone

A mixed-use zone along Hamilton's collector and arterial higher-order transit corridors that allows service commercial, retail, office and apartment-style residential uses in stand-alone or mixed-use buildings between 11.0 m and 22.0 m tall, built close to the street; single-detached, semi-detached, duplex and street townhouse dwellings are not permitted.

- Prohibited uses, even as accessory uses (11.1.2 i): Drive-Through Facility, Duplex Dwelling, Motor Vehicle Dealership, Motor Vehicle Gas Bar, Motor Vehicle Rental Establishment, Motor Vehicle Service Station, Motor Vehicle Washing Establishment, Semi-Detached Dwelling, Single Detached Dwelling, Street Townhouse Dwelling.
- Garden Centre is prohibited except as an accessory use to another permitted use (11.1.2 ii).
- Finished floor elevation of any dwelling unit must be at least 0.9 m above grade, but dwelling units are permitted in a basement or cellar (11.1.1.1 i).
- Residential Care Facility maximum capacity 20 residents; Emergency Shelter maximum capacity 50 residents (11.1.1.1 ii, iii).
- Emergency Shelters and Residential Care Facilities require a minimum 300 m radial separation (lot line to lot line) from any other lot occupied by a Residential Care Facility, Emergency Shelter, Corrections Residence or Correctional Facility; existing facilities closer than 300 m may be expanded/redeveloped up to the number of residents permitted by the zone (11.1.1.1 iv).
- Rooftop amenity area enclosures or rooftop access structures may project above the uppermost point of the building if: floor area does not exceed 10% of the storey directly beneath; set back at least 3.0 m from the exterior walls of the storey beneath; and not more than 3.0 m in vertical distance above the uppermost point of the building (11.1.3 d) iv).
- Maximum gross floor area for a Microbrewery: 700.0 m2 (11.1.3 e).
- Maximum gross floor area for an Office building: 4,000.0 m2 per individual building (11.1.3 f).
- Built form for new development (11.1.3 g): rooftop mechanical equipment must be located/screened from view of any abutting street; on an interior or through lot the ground floor facade facing the front lot line must be at least 75% of the front lot line length; on a corner lot the combined ground floor facade facing street lines must be at least 50% of all lot lines abutting the street; facade width excludes access driveways and any required yards within a lot line abutting a street.
- Maximum one driveway, maximum 6.0 m wide, permitted for ingress and egress (11.1.3 g) v).
- No parking, stacking lanes or aisles may be located between the required building facade and the front or flankage lot line (11.1.3 g) vi).
- All principal entrances must face the street and be accessible from the building facade with direct access from the public sidewalk (11.1.3 g) vii); notwithstanding the definition of planting strip, a sidewalk is permitted where required by Section vi) (11.1.3 g) viii).
- For properties designated under the Ontario Heritage Act, alternative building design or materials approved through a Heritage Permit are deemed to comply with 11.1.3 (11.1.3 g) ix).
- Minimum amenity area on a lot with more than 10 dwelling units: 4.0 m2 per dwelling unit less than 50 m2 and 6.0 m2 per dwelling unit more than 50 m2; outdoor amenity area must be unobstructed, at or above the surface, exposed to light and air, may include balconies and patios, and must be provided exclusively for the residential component and functionally separated from public areas of any commercial component (11.1.3 h).
- Visual barrier required along any lot line abutting a Downtown D5 Zone, Institutional Zone or Residential Zone per Section 4.19; no visual barrier permitted between the building facade and the street (11.1.3 i).
- No outdoor storage of goods, materials or equipment; display of goods or materials for retail purposes accessory to a retail use is permitted only in a front yard or flankage yard (11.1.3 j).
- Single detached, semi-detached and duplex dwellings existing at the date of passing (February 14, 2018) may be enlarged (subsection 34(10) Planning Act, in addition to 4.12 f) by not more than 10% of the gross floor area existing at that date; the 11.0 m minimum height of 11.1.3 d) i) does not apply; side yard setbacks of the addition may not be less than the existing side yard setbacks (11.1.4).
- Parking in accordance with Section 5 of the by-law (11.1.5).
- Accessory buildings in accordance with Section 4.8; accessory buildings and structures are not subject to the street-line setback of 11.1.3 a) (11.1.6).
- Urban Farmers Market in accordance with Section 4.28 (11.1.7).
- Community Gardens per Section 4.27 and Urban Farms per Subsection 4.26 (c), each permitted only in the rear yard or on the roof-top of the principal building (11.1.8).
