TOC4 zone, Hamilton: Transit Oriented Corridor Mixed Use High Density (TOC4) Zone

Section 11.4 (Subsections 11.4.1 to 11.4.6) of the City of Hamilton Zoning By-law 05-200, as amended by 18-032, 21-189, 24-137, 25-155.

A high-density mixed-use zone along the Centennial transit corridor where shops, services, offices and apartments (above the ground floor) sit in tall buildings built close to the street.

Other provisions in this section

  • Dwelling Unit, Mixed Use permitted only above the ground floor (11.4.1.1).
  • Prohibited even as accessory uses: Drive-Through Facility, Motor Vehicle Dealership, Motor Vehicle Gas Bar, Motor Vehicle Rental Establishment, Motor Vehicle Service Station, Motor Vehicle Washing Establishment (11.4.2 i).
  • Garden Centre prohibited except as an accessory use to another permitted use (11.4.2 ii).
  • Rooftop amenity enclosures / rooftop access structures may project above the building's uppermost point if: floor area not more than 10% of the storey directly beneath; set back at least 3.0 m from the exterior walls of the storey beneath; and not more than 3.0 m higher than the uppermost point of the building (11.4.3 d) v).
  • Built form for new development: rooftop mechanical equipment located and/or screened from view of any abutting street (11.4.3 g) i).
  • Interior or through lot: minimum width of ground floor facade facing the front lot line at least 75% of the front lot line length; corner lot: combined ground floor facade width facing street lines at least 75% of all lot lines abutting the street; facade width excludes access driveways and required yards along a street lot line (11.4.3 g) ii-iv).
  • No parking, stacking lanes or aisles between the required building facade and the front or flankage lot line (11.4.3 g) v).
  • At least one principal entrance within the ground floor facade closest to the street, accessible directly from the public sidewalk; a sidewalk is permitted within a planting strip for this purpose (11.4.3 g) vi-vii).
  • For commercial development existing at passing of the by-law, new commercial buildings are exempt from facade-width rules ii) and iii) if each building is max 650 m² GFA and minimum building height is 4.5 m instead of 11.0 m (11.4.3 g) viii).
  • Properties designated under the Ontario Heritage Act: alternative design or materials approved via a Heritage Permit deemed to comply (11.4.3 g) ix).
  • First storey minimum height 3.6 m, maximum height 4.5 m (11.4.3 g) x).
  • Minimum amenity area for dwelling units with a commercial use on a lot with more than 10 dwelling units: 4.0 m² per unit under 50 m², 6.0 m² per unit over 50 m²; outdoor amenity area must be unobstructed, at or above grade, exposed to light and air (may include balconies and patios); amenity area reserved exclusively for the residential component and functionally separated from commercial public areas (11.4.3 h).
  • Minimum 1.5 m wide planting strip where a lot line abuts a lot in a Residential or Institutional Zone and not a laneway (11.4.3 i).
  • Visual barrier required along any lot line abutting an Institutional or Residential Zone per Section 4.19; no visual barrier permitted between the building facade and the street (11.4.3 j).
  • No outdoor storage of goods, materials or equipment; retail display accessory to a retail use permitted only in a front yard or flankage yard (11.4.3 k).
  • Parking per Section 5 of the By-law (11.4.4).
  • Accessory buildings per Section 4.8; accessory buildings and structures are not subject to the street-line setback rules of 11.4.3 a) (11.4.5).
  • Urban Farmers Market per Section 4.28 (11.4.6).
