WF1 zone, Hamilton: Waterfront – Multiple Residential (WF1) Zone

A Hamilton waterfront (Pier 8 area) zone for apartment-style multiple dwellings, live/work units and educational uses, where building placement, height and street-facing design are controlled by the Special Figures in Schedule F rather than by conventional yard numbers.

Other provisions in this section

  • Maximum setback: shall be in accordance with Figure 11 of Schedule F: Special Figures (14.1.2 a)). No minimum yard setbacks or lot area/frontage standards are stated in the zone text.
  • Maximum setback to a garage: except where a visibility triangle is required, a maximum setback of 6.0 m applies to the portion of a building providing an access driveway to a garage (14.1.2 b)).
  • Minimum width of the ground floor facade facing the street for new development: per Figure 13 of Schedule F: Special Figures (14.1.2 d) i)).
  • All ground floor residential units fronting a street must have a principal entrance facing the street, accessible from the building facade with direct access from the street (14.1.2 d) ii)).
  • No parking, driveways or aisles may be located between a building facade and the front lot line or flankage lot line (14.1.2 d) iii) 1).
  • Blocks 11 and 13 of Figure 10 (Schedule F) additionally prohibit, between the building facade and the front/flankage lot line: direct driveway access to individual units, garages fronting streets, and front yard parking (14.1.2 d) iii) 2).
  • All parking areas must be at the rear of buildings, underground and/or in above-grade structures, with access from streets or laneways (14.1.2 d) iv)).
  • Above-grade parking structures must be located within buildings and fronted on all levels by residential uses, except for driveway access (14.1.2 d) v)).
  • Minimum 40% of the ground floor facade facing a street must be windows; window/door frames, clear glazed transoms and sidelights, doors with at least 50% clear glazing and a sill up to 0.6 m high count toward clear glazed area; signage and opaque/spandrel glazing do not (14.1.2 d) vi)).
  • Section 14.0 A): Figure 10 of Schedule F identifies the Blocks referenced in the WF1, WF2 and WF3 zones.
  • Section 14.0 B) i): Live/Work Unit means a dwelling unit with an at-grade entrance containing one dwelling unit with only one of Office (excluding Medical Clinic), Personal Service, Retail or Studio on the ground floor; the commercial component may not exceed 50.0 m2 gross floor area.
  • Section 14.0 B) ii): a rooftop amenity access structure is excluded from measured building height and counted as a storey if its floor area is at most 10% of the storey beneath, it is set back at least 3.0 m from the exterior walls of the storey beneath, and it is not more than 3.0 m high; it may include an enclosed amenity area.
  • Section 14.0 B) iii): an interior balcony or mezzanine is not a storey.
  • Section 14.0 C): Section 4.23 d) of the By-law does not apply in Waterfront Zones.
  • Section 14.0 D) i) parking (notwithstanding 5.6 c)): Multiple Dwelling and Live/Work Unit 0.70 spaces per dwelling unit, or 0.3 spaces per unit where the unit is 50 m2 gross floor area or less; Educational Establishment 1.25 per classroom; other institutional, commercial and open space rates listed in the Section 14.0 table (e.g. Office 2 per 100 m2 in excess of 450 m2, Retail 1.5 per 100 m2, Personal Service 1 per 16.0 m2, Studio 1 per 50 m2 in excess of 450 m2).
  • Section 14.0 D) ii): required parking within Pier 8 may be on a different lot within 300 m of the lot containing the use.
  • Section 14.0 D) iii): short-term bicycle parking minimum 10 spaces per Multiple Dwelling building; long-term bicycle parking 0.5 per dwelling unit for Multiple Dwelling and Live/Work Unit (in addition to Section 5.7).
  • Section 14.0 D) iv): existing parking exceeding the maximum standard may be eliminated but never below the minimum in D) i).
  • Section 14.0 E): all required parking must be provided within Blocks 1 through 16 on Schedule A of the by-law.
