Section 14.3 (with Section 14.0 Waterfront Zone general provisions) of the City of Hamilton Zoning By-law 05-200, as amended by 17-095-LPAT-01, 21-189, 24-137, 25-155.
A mixed-use waterfront zone (Pier 8 area) for 6-storey buildings with shops, restaurants and other commercial uses on the ground floor and apartments or offices above, built close to the street with parking at the rear.

Other provisions in this section
- Restricted uses (14.3.1.1 i / 14.3.3 e): all commercial uses except Office and Personal Service are permitted only on the ground floor; commercial uses shall be oriented to the southerly and easterly streets for Block 4, the southerly and westerly streets for Block 6, and the northerly and westerly streets for Block 9 (Figure 10 of Schedule F).
- Residential restriction (14.3.1.1 ii / 14.3.3 f): a maximum of 30% of the ground floor facade may be occupied by residential uses facing the southerly lot line of Block 4, the southerly lot line of Block 6, and the westerly lot line of Block 9.
- Additional Residential Unit restrictions apply in accordance with Figure 14 of Schedule F: Special Figures (14.3.1.1 iii / 14.3.3 g).
- Prohibited uses (14.3.2): Motor Vehicle Collision Repair Establishment, Motor Vehicle Rental Establishment, Motor Vehicle Service Station, Motor Vehicle Gas Bar; a Drive-Through Facility is prohibited even as an accessory use.
- Maximum setback per Figure 11 of Schedule F; maximum 6.0 m setback for the portion of a building providing an access driveway to a garage, except where a visibility triangle is required (14.3.3 a, b).
- Building height: minimum 9.0 m; minimum 4.5 m facade height for the first storey along a street line; maximum 6 storeys and up to 24.5 m (14.3.3 c).
- Built form for new development (14.3.3 d): minimum ground floor facade width per Figure 13 of Schedule F; at-grade residential units and commercial uses fronting a street must have a principal entrance facing the street with direct access from the street; no parking, driveways or aisles between a building facade and a street; parking areas at the rear of buildings with access from streets or laneways; minimum 40% of the ground floor facade facing a street must be windows and glazing.
- Section 14.0 B) i): a Live/Work Unit is a dwelling unit with an at-grade entrance containing one dwelling unit with only one of Office (excluding Medical Clinic), Personal Service, Retail or Studio on the ground floor; commercial component GFA not to exceed 50.0 m2.
- Section 14.0 B) ii): a rooftop amenity access structure is excluded from building height and counted as a storey if its floor area is at most 10% of the storey beneath, it is set back at least 3.0 m from the exterior walls of the storey beneath and is not more than 3.0 m in height; an interior balcony or mezzanine is not a storey (B iii).
- Section 14.0 C): Section 4.23 d) of the By-law does not apply to Waterfront Zones.
- Parking (Section 14.0 D) i), notwithstanding Section 5.6 — a general Waterfront Zone standard, not stated in Section 14.3): Live/Work Unit and Multiple Dwelling 0.70 per dwelling unit (0.3 per unit where the unit is 50 m2 gross floor area or less); Retail 1.5 spaces per 100 m2; Restaurant, Repair Service, Place of Assembly, Beverage Making Establishment, Catering Service, Commercial Entertainment, Communications Establishment, Craftperson's Shop and Medical Clinic 3 spaces per 100 m2; Financial Establishment 4 spaces per 100 m2; Office 2 spaces per 100 m2 in excess of 450 m2; Commercial School and Studio 1 space per 50 m2 in excess of 450 m2; Personal Service 1 for each 16.0 m2; Educational Establishment 1.25 per classroom.
- Section 14.0 D) ii): required parking within Pier 8 may be located on another lot within 300 m of the lot containing the use.
- Section 14.0 D) iii): bicycle parking - Multiple Dwelling minimum 10 short-term spaces in each building; long-term 0.5 spaces per dwelling unit for Multiple Dwelling and Live/Work Unit.
- Section 14.0 D) iv): existing parking exceeding the maximum standard may be eliminated but never below the minimum in D) i).
- Section 14.0 E): all required parking must be provided within Blocks 1 through 16 as indicated on Schedule A.
