P8 zone, Hamilton: Conservation/Hazard Land Rural (P8) Zone

Section 7.8 (7.8.1 Permitted Uses; 7.8.2 Regulations, 7.8.2.1-7.8.2.2) of the City of Hamilton Zoning By-law 05-200, as amended by 19-062, 15-173.

The P8 zone covers Provincially Significant Wetlands in rural Hamilton; no new buildings or expansions are allowed, and only an existing home or other existing structure may be rebuilt in its original footprint.

Other provisions in this section

  • Applies to all lands identified as a Provincially Significant Wetland in the Rural Hamilton Official Plan (explanatory note).
  • New development may require Site Plan Control approval, including an Environmental Impact Statement showing no negative impact on Core Area features identified in the Rural Hamilton Official Plan, before development proceeds (explanatory note).
  • 7.8.2.1: For agriculture and existing single detached dwellings, new buildings or structures, or expansions to existing buildings and structures, are not permitted.
  • 7.8.2.2(i): Notwithstanding 7.8.2.1, an existing building or structure (including an existing single detached dwelling) demolished in whole or in part may be rebuilt provided the setbacks that existed on the date of passing of the By-law are maintained.
  • 7.8.2.2(ii): Notwithstanding (i), a maximum encroachment of up to 10% of the existing setbacks determined under (i) may be permitted.
  • 7.8.2.2(iii): Notwithstanding 7.8.2.1, an existing legally established accessory building or structure demolished in whole or in part may be rebuilt provided the setbacks, building height and gross floor area that existed on the date of passing of the By-law are maintained.
  • Uses accessory to the permitted uses are also permitted.
