CMU zone, Vaughan: Community Commercial Mixed-Use Zone

Part 8, Section 8.2 (8.2.1 Table 8-2; 8.2.2 Table 8-3) of the City of Vaughan Zoning By-law 001-2021.

A community commercial mixed-use zone for offices, shops, services, restaurants, hotels and community facilities in mid-rise buildings (up to 32 m) on larger lots; the retail/service group of uses is capped at 30% of lot gross floor area and no residential dwellings are permitted.

Other provisions in this section

  • Required build-to zone: 3.5-7 m from the front lot line, applying to a minimum of 50% of the street frontage (55% on a corner lot); on the rest of the lot only the minimum setback applies (Table 8-3 note 5).
  • Minimum building height 11.0 m; minimum street wall 8 m; minimum ground floor height 4.5 m.
  • Podium and tower requirements apply to any building taller than 20.0 m: minimum podium height 10.5 m, maximum podium height 20 m, minimum tower step-back 3 m, maximum tower floor plate - no requirement, minimum tower separation 15 m, minimum tower setback from any rear or interior side lot line 7.5 m.
  • 45-degree angular plane applies from the rear lot line and interior side lot line where the CMU Zone abuts any Residential Zone except RM2 and RM3 (Table 8-3 note 6).
  • Surface parking lots permitted, but no part of a surface parking area may be in the front yard or exterior side yard (driveways excepted) (Table 8-3 note 7); above-grade parking structures not permitted; below-grade parking structures permitted.
  • Minimum landscape strip abutting a street line: 3.5 m wide.
  • Minimum landscape strip on any interior side or rear lot line abutting a Residential Zone or Open Space Zone: 3 m wide.
  • Minimum landscaped area: 10% of the lot.
  • Table 8-2 note 2: uses so marked (business service, clinic, financial institution, health and fitness centre, personal service, pet care/pet services establishments, restaurant, take-out restaurant, retail, convenience retail, service or repair shop, supermarket, veterinary clinic, outdoor display area, outdoor patio) are only permitted as part of a mixed-use development and together are limited to a maximum of 30% of the gross floor area of all uses on the lot.
  • Table 8-2 note 5: maximum gross floor area on each lot for all uses so marked is 10,000.0 m2.
  • Table 8-2 note 6: uses so marked (funeral services, hotel, small-scale hotel, place of assembly, community facility, day care centre, place of worship) are not permitted abutting a freight rail facility.
  • Table 8-2 note 1: fueling station, micro-manufacturing, community garden, place of worship, outdoor display area, outdoor patio, seasonal outdoor display area and temporary sales office are subject to specific use provisions in Part 5.
  • Fueling station is permitted only if legally existing and used on the lot on the effective date of the By-law ('E').
  • No residential uses (apartment, block/multiple-unit/podium/street townhouse, live-work, retirement residence, supportive or independent living facility), no long term care facility, school, post-secondary school, car wash, automotive detailing, commercial storage, motor vehicle body repair/rental/repair/sales, drive-through, home occupation, secondary suite or short-term rental are permitted in the CMU Zone.
  • Table 8-3 notes 1 (requirements do not apply to existing buildings and structures), 2, 3 (urban squares, driveways and walkways permitted within the build-to zone up to 25% of the build-to zone requirement), 4 and 8 appear in the Part 8 'Additional requirements to Table 8-3' list but are NOT flagged anywhere in the CMU column, so they do not apply to this zone.
