Other provisions in this section

  • Minimum building height 24.0 m (Table 8-3).
  • Required build-to zone 5-10 m from the street line; applies to a minimum of 60% of the street frontage (minimum 50% on a corner lot); on any other portion of the lot only the minimum setback applies (Table 8-3 note 2).
  • Urban squares, driveways and walkways are permitted within the build-to zone provided their cumulative total does not exceed 25% of the total build-to zone requirement (Table 8-3 note 3).
  • Minimum street wall height 9 m.
  • Minimum ground floor height 4.5 m.
  • 45-degree angular plane applies, measured from the rear lot line and interior side lot line, only where the HMU Zone abuts a Residential Zone other than RM2 or RM3 (Table 8-3 note 6).
  • Podium and tower requirements apply to any building with a height greater than 20.0 m: minimum podium height 10.5 m; maximum podium height 20 m; minimum tower step-back 3 m; maximum tower floor plate 850 m2; minimum tower separation 30 m; minimum tower setback from any rear lot line and interior side lot line 12.5 m.
  • Parking is permitted as a surface parking lot, above-grade parking structure, or below-grade parking structure.
  • Surface parking is prohibited in all yards except the rear yard; this does not prevent a driveway in any yard (Table 8-3 note 8).
  • Minimum landscape strip abutting a street line: 5 m wide.
  • Minimum landscape strip on any interior side lot line or rear lot line abutting a Residential Zone or Open Space Zone: 3 m wide.
  • Minimum landscape percentage: no requirement stated ('-').
  • Uses marked note 3 (art studio, business service, clinic, financial institution, health and fitness centre, personal service, pet care establishment, pet services establishment, restaurant, take-out restaurant, retail, convenience retail, service or repair shop, supermarket, veterinary clinic, outdoor display area, outdoor patio) are permitted only as part of a mixed-use development and together are limited to a maximum of 50% of the gross floor area of all uses on the lot (Table 8-2 note 3).
  • Apartment dwelling and podium townhouse dwelling: the ground floor frontage shall consist of a maximum of 40% of these uses (Table 8-2 note 4).
  • Note-5 uses permitted in HMU (business service, financial institution, funeral services, health and fitness centre, hotel, hotel (small scale), personal service, pet care establishment, pet services establishment, place of entertainment, restaurant, take-out restaurant, retail, convenience retail, service or repair shop, shopping centre, supermarket, theatre): maximum combined gross floor area of 10,000.0 m2 per lot (Table 8-2 note 5). The other note-5 rows in Table 8-2 (commercial storage, motor vehicle sales) are not permitted in HMU.
  • Uses marked note 6 (funeral services, hotel, hotel (small scale), place of assembly, apartment dwelling, independent living facility, retirement residence, community facility, day care centre, long term care facility, place of worship, school, post-secondary school) are not permitted abutting a freight rail facility (Table 8-2 note 6).
  • Uses marked note 1 (fueling station, micro-manufacturing, independent living facility, community garden, place of worship, home occupation, outdoor display area, outdoor patio, seasonal outdoor display area, short-term rental, temporary sales office) are subject to the specific use provisions of Part 5.
  • Fueling station is permitted only if legally existing and used on the lot on the effective date of the By-law ('E').
  • Not permitted in HMU: car wash, automotive detailing, commercial storage, motor vehicle body repair, motor vehicle rental, motor vehicle repair, motor vehicle sales, block townhouse dwelling, multiple-unit townhouse dwelling, street townhouse dwelling, drive-through, secondary suite.
  • Table 8-3 note 1 (requirement does not apply to existing buildings and structures) is not flagged against any HMU value in the source text.
