A heavy industrial zone on Hamilton Port Authority lands along the harbour (Piers 11-12, 14, 15 and 22-24, north of Burlington Street) for shipping, navigation and port-related industry; homes and child care centres are not allowed.

Other provisions in this section

  • Prohibited uses (9.13.2, By-law 25-155): Child Care Centre and Dwelling Unit are prohibited, even as an accessory use.
  • Planting strip abutting a street (9.13.3 c): a minimum 3.0 m wide planting strip must be provided and maintained abutting Burlington Street, except at points of ingress and egress, and may not be used for outdoor display.
  • Outdoor storage and outdoor assembly (9.13.3 d): combined shall not exceed 85% of the total lot area.
  • Office use (9.13.3 e): maximum gross floor area for Office use within an individual building is 3,000 m2.
  • Industrial Administrative Office (9.13.3 f): maximum gross floor area is 10,000 m2 on a lot.
  • Accessory retail and showroom area (9.13.3 g): maximum combined GFA is 25% of the GFA of the principal use or 500.0 m2, whichever is the lesser.
  • Waste Processing Facility / Waste Transfer Facility (9.13.3 h): any building, structure or land used for these must be a minimum of 300.0 m from a Residentially Zoned or Institutionally Zoned property lot line, in addition to the other 9.13.3 regulations.
  • Stockpiles of salt and soils (9.13.3 i): not located within 250 m of a lot line abutting a Residential Zone or Institutional Zone; must be secured and protected with a roofed structure with a minimum of three walls (in addition to clause d).
  • Parking (9.13.3 j): in accordance with Section 5 of the By-law (the clause heading is blank in the source text).
  • Accessory buildings (9.13.3 k): must comply with Section 9.13.3; no accessory building is permitted within a front yard or a flankage yard.
