Section 9.3 (Regulations: Section 9.3.3) of the City of Hamilton Zoning By-law 05-200, as amended by 10-128, 11-276, 12-132, 14-163, 17-220, 18-219, 18-266, 19-062, 21-189, 24-137, 25-155.
A business-park zone for offices, light manufacturing, warehouses, labs, hotels and similar employment uses on large lots (at least 4,000 m²) with landscaped street frontages; homes, child care centres and places of worship are not allowed.

- Prohibited manufacturing uses even as accessory (s. 9.3.2 i): concrete crushing; rock crushing; manufacturing of asbestos, phosphate or sulphur products; primary production of chemicals, synthetic rubber, plastic, asphalt or cement (not including mixing, blending, treatment or similar process); processing or refining of petroleum or coal; processing, milling or packaging of animal feed; salvage yard; slaughtering, eviscerating, rendering or cleaning of meat, poultry or fish or by-products; smelting of ore or metal; tanning or chemical processing of pelts or leather; vulcanizing of rubber or rubber products; explosives manufacturing; pulp and paper mills.
- Prohibited uses even as accessory (s. 9.3.2 ii): Child Care Centre, Dwelling Unit, Place of Worship (By-law 25-155).
- Motor Vehicle Washing Establishment permitted only as an accessory use to a Motor Vehicle Service Station (s. 9.3.2 iii, By-law 19-062).
- Minimum 6.0 m yard from any portion of a lot line abutting a lot line within a Residential Zone or Institutional Zone (s. 9.3.3 c).
- Any building or structure used for Manufacturing or an Alcohol Production Facility must be set back a minimum of 20.0 m from any portion of a lot line abutting a lot line within a Residential or Institutional Zone (s. 9.3.3 e).
- Outdoor training facilities associated with a Trade School are prohibited (s. 9.3.3 f).
- Maximum gross floor area for Office use within an individual building, excluding accessory office, is 3,000 m² (s. 9.3.3 g).
- An Industrial Administrative Office or a Surveying, Engineering, Planning or Design Business is limited to a gross floor area of less than 10,000 m² on a lot (s. 9.3.3 h).
- Total combined gross floor area of Office, Industrial Administrative Office and Surveying/Engineering/Planning/Design Business uses shall not exceed 4,000.0 m² per individual building (s. 9.3.3 i, By-law 24-137).
- Landscaped Area: minimum 6.0 m wide strip abutting a street (except at points of ingress/egress); within it a minimum 3.0 m wide Planting Strip between parking spaces, aisles or driveways and a street; properties adjacent to Trinity Church Road south of Rymal Road East also require a 6.0 m wide Landscaped Area; a minimum 3.0 m wide Planting Strip where a lot line abuts a lot line within a Residential or Institutional Zone (s. 9.3.3 j).
- Visual Barrier required along any portion of a lot line abutting a lot line within a Residential or Institutional Zone per Section 4.19; also required within the Landscaped Area for properties adjacent to Trinity Church Road south of Rymal Road East (s. 9.3.3 k; the printed cross-reference to 'Section 9.3.3 i)' means clause j)).
- Outdoor Storage and Outdoor Assembly permitted only in conjunction with a building: not in a Front Yard or required Flankage Yard; not in a Flankage Yard along Barton Street/Barton Street East, Dickenson Road East, Fruitland Road, Garner Road West, Highway No. 5 West, Highway No. 6, Rymal Road East, Shaver Road, South Service Road, Stone Church Road East, Trinity Church Road Extension, Trinity Road, Upper Ottawa Street or Wilson Street West; max 85% of total lot area; minimum 20.0 m setback from any portion of a lot line abutting a lot line within a Residential or Institutional Zone plus a Visual Barrier per Section 4.19; minimum 24.0 m setback from any portion of the lot lines of 1023 Barton Street and 320, 324, 328, 332, 336, 340 and 344 McNeilly Road; screened from view from any abutting street by a Visual Barrier per Section 4.19 (s. 9.3.3 l).
- Outdoor Display permitted only as an accessory use: allowed in a yard abutting a street but no closer than 3.0 m to the lot line; combined area limited to 25% of the Landscaped Area required by the landscaped-strip clause (s. 9.3.3 m; printed as 'Section 9.3.3 i) i)', which is clause j) i)).
- Maximum gross floor area for an Alcohol Production Facility: 5,000 m² (s. 9.3.3 n, By-law 18-219).
- Access to Trinity Church Road south of Rymal Road East is prohibited for all new development (s. 9.3.3 o).
- Maximum combined gross floor area for accessory retail, showroom area and tasting room: 25% of the gross floor area of the principal use or 500.0 m², whichever is the lesser; retail or accessory retail associated with a motor vehicle service station limited to 280 m² (s. 9.3.3 p).
- Parking in accordance with Section 5 of the By-law (s. 9.3.3 q).
- Accessory buildings per Section 4.8 of the By-law; no accessory building permitted within a front yard or flankage yard (s. 9.3.3 r).
- Restaurants permitted only: on South Service Road between Lake Avenue and Winona Road (not on a property with frontage on Fruitland Road); on Barton Street between Lake Avenue and Winona Road (not on a property with frontage on Fruitland Road); on the north side of Highway #5 west of Highway #6; these location limits do not apply to restaurants accessory to a use on the property. For restaurants in the South Service Road and Barton Street locations, maximum gross floor area 280 m² whether freestanding or within a multi-tenant building; on a property with frontage on South Service Road no restaurant may occupy more than 30% of the total gross floor area on the property (s. 9.3.3 s).
- Cannabis Growing and Harvesting Facility: no outdoor storage or outdoor assembly permitted; retail sales permitted per the accessory retail clause; any building or structure used for a Medical Marihuana Growing and Harvesting Facility set back a minimum 20.0 m from any portion of a lot line abutting a lot line within a Residential, Commercial or Institutional Zone; notwithstanding Section 4.12 c), any building or structure for the facility set back a minimum of 150 m from any portion of a lot line abutting a Residential, Institutional or Commercial and Mixed Use Zone, and from any residential dwelling unit existing at the date of passing of the by-law, farm labour residence, mobile home, educational establishment, residential care facility, place of worship, daycare or park in a Rural Classification Zone (s. 9.3.3 t).
