M4 zone, Hamilton: Business Park Support (M4) Zone

Section 9.4 (Sections 9.4.1 Permitted Uses, 9.4.2 Prohibited Uses, 9.4.3 Regulations) of the City of Hamilton Zoning By-law 05-200, as amended by 10-128, 11-276, 12-132, 17-220, 18-219, 19-062, 21-189, 24-137, 25-155.

A business-park zone for offices, light manufacturing, warehouses, hotels, restaurants, shops and similar support uses on large lots (at least 4,000 square metres), with buildings kept close to the street and extra setbacks, height limits and screening where the lot borders homes or institutions.

Other provisions in this section

  • 9.4.2 i): the following manufacturing uses are prohibited even as accessory uses: beverage distillation; breweries; concrete crushing; manufacturing of asbestos, phosphate or sulphur products; primary production of chemicals, synthetic rubber, plastic, asphalt or cement (not including mixing, blending, treatment or similar process); processing or refining of petroleum or coal; processing, milling or packaging of animal feed; rock crushing; salvage yard; slaughtering, eviscerating, rendering or cleaning of meat, poultry or fish or by-products; smelting of ore or metal; tanning or chemical processing of pelts or leather; vulcanizing of rubber or rubber products; explosives manufacturing; pulp and paper mills.
  • 9.4.2 ii): Child Care Centre, Dry Cleaning Plant, Dwelling Unit and Place of Worship are prohibited, even as accessory uses (By-law 25-155).
  • 9.4.2 iii): a Motor Vehicle Washing Establishment is permitted only as an accessory use to a Motor Vehicle Service Station (By-law 19-062).
  • 9.4.3 b): yard abutting a street minimum 6.0 m and maximum 27.0 m; the maximum does not apply to additional buildings where an existing conforming building's ground-floor facade is 25% or more of any street line; on a corner lot the maximum applies to only one street lot line.
  • 9.4.3 c): minimum 6.0 m yard from any lot line abutting a lot line within a Residential Zone or an Institutional Zone.
  • 9.4.3 d): maximum building height 11.0 m abutting a Residential or Institutional Zone, which may be equivalently increased as the yard increases beyond the 6.0 m minimum in 9.4.3 c).
  • 9.4.3 e): any building or structure used for Manufacturing must be set back a minimum 20.0 m from any lot line abutting a lot line within a Residential or Institutional Zone.
  • 9.4.3 f): outdoor training facilities associated with a Trade School are prohibited.
  • 9.4.3 g): Medical Clinic limited to a combined total of 3,000 m2 gross floor area on a lot.
  • 9.4.3 h): Office use within an individual building (excluding accessory office) limited to a maximum 3,000 m2 gross floor area.
  • 9.4.3 i): an Industrial Administrative Office or a Surveying, Engineering, Planning or Design Business limited to a gross floor area of less than 10,000 m2 on a lot.
  • 9.4.3 i) (second, By-law 24-137): total combined gross floor area of any Office, Industrial Administrative Office and Surveying, Engineering, Planning or Design Business uses shall not exceed 4,000.0 m2 per individual building.
  • 9.4.3 j) i): Financial Establishment, Personal Service, Restaurant and Retail are permitted only on the ground floor of a building or at grade on any lot.
  • 9.4.3 j) ii): an individual Retail Establishment is restricted to a maximum gross floor area of 500.0 m2.
  • 9.4.3 k): minimum 6.0 m wide Landscaped Area abutting a street (except at points of ingress and egress); within it a minimum 3.0 m wide Planting Strip between parking spaces, aisles or driveways and the street; minimum 3.0 m wide Planting Strip where a lot line abuts a Residential or Institutional Zone.
  • 9.4.3 l): a Visual Barrier per Section 4.19 must be provided along any lot line abutting a lot line within a Residential or Institutional Zone.
  • 9.4.3 m): Outdoor Storage and Outdoor Assembly permitted only in conjunction with a building; not permitted in a Front Yard or required Flankage Yard; not permitted in a Flankage Yard along Barton Street/Barton Street East, Dickenson Road East, Fruitland Road, Garner Road West, Highway No. 5 West, Highway No. 6, Rymal Road East, Shaver Road, South Service Road, Stone Church Road East, Trinity Church Road Extension, Trinity Road, Upper Ottawa Street or Wilson Street West; shall not exceed 85% of total lot area; minimum 20.0 m setback from a lot line abutting a Residential or Institutional Zone and screened by a Visual Barrier (Section 4.19); screened from any abutting street by a Visual Barrier (Section 4.19).
  • 9.4.3 n): Outdoor Display permitted only as an accessory use; allowed in a yard abutting a street but no closer than 3.0 m to the lot line; combined area limited to a maximum 25% of the Landscaped Area.
  • 9.4.3 o): accessory retail and showroom area limited to the lesser of 25% of the gross floor area of the principal use or 500.0 m2; retail or accessory retail associated with a motor vehicle service station limited to 280 m2 gross floor area.
  • 9.4.3 p): parking in accordance with Section 5 of the By-law.
  • 9.4.3 q): accessory buildings per Section 4.8; no accessory building permitted within a front yard or flankage yard except a structure for security purposes.
