A downtown Burlington zone for apartment buildings and retirement homes on lots of at least 1,000 m² and 30 m wide, up to 22 m tall and 185 units per hectare, with limited office uses.

Other provisions in this section

  • Regulations in Table 6.6.1 apply to Apartment Building and Retirement Home (the only building types in the table).
  • Amenity area: 20 m² per unit (Table 6.6.1).
  • Building setback from a creek block: 7.5 m; 4.5 m if the block includes a 3 m buffer (Table 6.6.1).
  • Yard abutting a Pipeline Easement: 7 m rear yard; 3 m side yard (Table 6.6.1).
  • Yard abutting R1, R2, R3 or DRL zones: 15 m (Table 6.6.1).
  • Parking: 1.00 occupant space per unit and 0.25 visitor spaces per unit, otherwise per Part 1 s.2.25; 100% of occupant parking must be enclosed (s.6.2(a),(b)).
  • Notwithstanding s.6.3, a parking lot may be set back 1 m from a street line if a decorative wall or fence 1 m to 1.2 m high screens it from the street (s.6.2(c)(i)).
  • Parking spaces and driveways must be set back 3 m from a building wall containing windows of habitable rooms in ground-floor or basement dwelling units (s.6.2(c)(ii)).
  • Landscape area: 3 m abutting a street with deemed width up to 26 m; 4.5 m abutting a street with deemed width greater than 26 m; 3 m abutting a creek block or O3 zone (s.6.3).
  • Landscape buffer: 6 m abutting R1, R2, R3 or DRL zones; 3 m abutting other residential zones (s.6.3).
  • Waste stored outside must be kept within a solid screened enclosure (s.6.4).
  • On lands abutting a residential, DRM or DRL zone, fencing at least 1.8 m high (solid screen or chain-link plus dense year-round landscape planting) must be installed along the common boundary (s.6.5).
  • All residential uses in Table 6.2.2 are subject to Part 2, Subsection 2 'Prohibited Uses' (Table 6.2.2 note (a)).
  • Prohibited in all Part 6 zones, in addition to Part 1 s.2.22: warehouse club, lumber sales, swimming pool sales and service, RV and utility trailer sales and service, boat/motorcycle/snowmobile sales and service, heavy machinery sales and service, car wash, video game/pinball arcade, propane cylinder handling facility, bulk propane storage depot, adult entertainment establishment (s.3).
  • Holding 'H' prefix: uses per Part 11 s.1.1; development deemed premature until the H is removed per Part 11 s.1.2 (s.1(a)).
  • Lands adjacent to Lake Ontario and Burlington Bay: refer to Part 1 s.2.30; side yards for L-shaped dwellings, parking spaces/driveways and parking structures: refer to Part 2 s.1 (s.1(b)-(e)).
  • Subject to Part 1 (General Conditions and Provisions) and Part 14 (Exceptions to Zone Designations) (s.1).
  • Funeral homes in DC zone are not permitted on lands abutting DRH; night clubs in DC/DW/DL zones are not permitted within 45 m of DRH zones (Table 6.2.1 notes (b),(e)).
