Other provisions in this section

  • Yard abutting a utility easement (Table 2.29.2): 2.5 m dwelling, 5.5 m garage, 5 m for storeys above garage.
  • Maximum driveway width (Table 2.29.3), Triplex or Fourplex by front/street side lot width: less than 9 m = 3 m; 9 m to less than 16 m = 5.5 m; 16 m or greater = 8.5 m. Stacked or Back-to-back Townhouse: 3 m driveway width per unit. Otherwise Part 1, Subsection 2.24 applies.
  • In addition to the maximum driveway width, a walkway up to 1.5 m wide is permitted (s.29.3.1(a)); remaining lot area between the street line and the street-facing building elevation must be landscaped open space (b); triplex/fourplex limited to one driveway per property (c).
  • Encroachments (s.29.4; Part 1 ss.2.3 and 2.13 apply as amended): porches may encroach up to 1.5 m into the required front and street side yard; balconies on a front/street-side wall may project up to 2.5 m beyond the wall, to within 1.5 m of the property line; rooftop terraces must meet the setbacks of the storey below; bay windows, balconies, vestibules, fire escapes or open stairways may not project into a required side yard of 1.2 m or less; for back-to-back and stacked townhouses a deck's rear yard setback equals the required rear yard.
  • Parking (s.29.6; Part 1 ss.2.25 and 2.26 apply as amended): for stacked townhouses, driveways and parking lots set back 1.5 m from a wall containing habitable-room windows (not applicable where the space/driveway is for the unit occupant's exclusive use); below-grade parking structures projecting less than 1.6 m above grade set back 1 m from all other property lines and street lines; no loading space required for triplexes or fourplexes 4 storeys or more (notwithstanding Part 1 s.2.25.3).
  • Amenity area (s.29.7): stacked and back-to-back townhouses need at least one common amenity area of at least 100 m², or 6 m² per unit total, whichever is greater.
  • Privacy area (s.29.8): stacked and back-to-back townhouses 5.5 m² per unit.
  • Landscape area abutting a street (s.29.9): 1.5 m.
  • Apartment buildings (s.26 note h, MXG rules as amended): max 4 storeys and 18 m; front/street side yard 3 m; rear yard 9 m; side yard 4.5 m; yard abutting a residential zone 3 m; no maximum yard abutting a street; setback from a creek block 3 m; density min 26 / max 225 units per hectare; landscape buffer abutting a residential zone 0 m; amenity area 15 m² per efficiency unit, 25 m² per unit; parking 1 space per 1-bedroom unit, 1.25 per 2-bedroom, 1.5 per 3+ bedroom, 0.25 visitor spaces per unit, plus 1 maintenance space per 75 units.
  • Retail/service commercial uses (convenience/specialty food store, convenience restaurant, other retail) only on the ground floor of a two-storey or more apartment building with frontage on a public street (s.26 note d).
  • General (Part 2 s.1): 'H' holding prefix defers development until removed per Part 11; accessory buildings, patios/decks, fences, pools per Part 1 ss.2.2-2.5; lands adjacent to Lake Ontario and Burlington Bay per Part 1 s.2.30; parking lots set back 4.5 m from a street line; for townhouses, stacked/back-to-back townhouses and apartments up to 3 storeys, driveways/parking lots set back 3 m from habitable-room windows (unless for the unit occupant's exclusive use) and parking spaces 6 m from R1, R2, R3, LN3-LN6 zones; for apartments 4+ storeys, driveways 9 m and parking spaces 6 m from ground-floor/basement habitable windows, and 6 m from R1, R2, R3, LN3-LN6 zones; enclosed parking structures more than 1.6 m above grade meet principal building yards, those up to 1.6 m above grade set back 3 m from a street line and may not encroach a required landscape buffer abutting a residential zone.
  • Prohibited (Part 2 s.2, plus Part 1 s.2.22): parking/storing motor vehicles over 3000 kg GVW, 6 m long or 2.6 m high (except recreational vehicles); stake-body vehicles; recreational vehicles or utility trailers exceeding 3.6 m combined height; any vehicle, boat, trailer or similar within a landscaped open space area.
