By-law 2020 Part 2, Sections 1-2, 21 and 25 (Table 2.21.1, Table 2.25.1, Subsections 25.1-25.6) of the City of Burlington Zoning By-law 09-2026 / 2020.

A higher-density Alton Community zone intended mainly for apartment buildings and retirement homes up to ten storeys, with townhouses, stacked townhouses and small multi-unit dwellings also allowed under other zones' rules.

Other provisions in this section

  • Table 2.25.1 applies to apartment buildings and retirement homes only; other dwelling types use the regulations of the zones referenced in Table 2.21.1 footnotes (RAL2, RM1, RM2, RAL3, RM3).
  • Yard abutting Dundas Street (Table 2.25.1 note a): floors 1-2 minimum 3 m and maximum 6 m (maximum applies to first floor only); floors 3-4 as for floors 1-2 plus 2 m for each additional floor; floors 5-10 as for floors 1-2 plus 6 m.
  • Yard abutting an RAL1, RAL2, RAL3 or LN8 zone (note b): buildings up to 6 storeys 15 m; over 6 storeys 15 m plus 1 m per storey over 6; where the building wall exceeds 30 m in length, add 1 m for each 5 m of wall length over 30 m.
  • All other yards (note c): buildings up to 6 storeys 7.5 m; over 6 storeys half the building height; where the building wall exceeds 30 m in length, add 1 m for each 5 m of wall length over 30 m.
  • Rear dwelling setback abutting a creek block: 7.5 m, or 4.5 m if the block includes a 3 m buffer; side building setback abutting a creek block: 3 m.
  • Yard abutting a pipeline easement: 7 m; yard abutting a railway right-of-way: 30 m.
  • Density (25.2): apartment building minimum 50 and maximum 185 units per hectare; retirement home maximum floor area ratio 1.25:1.
  • Parking (25.3): per Part 1, Subsection 2.25 (Off-Street Parking and Loading); 75% of all required occupant parking shall be enclosed.
  • Building height (25.4): ten storeys maximum.
  • Landscaping (25.5): landscape buffer 3 m abutting Dundas Street; 6 m abutting a property line not abutting Dundas Street.
  • Amenity area (25.5): 25 m² per bedroom; 15 m² per efficiency unit.
  • Outside storage (25.6): waste stored outside shall be kept within a solid screen enclosure.
  • Duplex and triplex dwellings (Table 2.21.1 note b): RM1 regulations except triplex lot width 6.5 m; front and street side yard setback 3 m to dwelling and 6 m to garage; maximum driveway width 3 m (notwithstanding Part 1 s.2.24) plus one walkway up to 1.5 m wide.
  • Fourplex dwellings (note c): RM2 regulations except front and street side yard setback 3 m to dwelling and 6 m to garage; maximum driveway width 3 m plus one walkway up to 1.5 m wide.
  • Townhouse and street townhouse dwellings (note d): RAL3 regulations except yard abutting an RAL1, RAL2 or LN2 zone 12 m; maximum density for street townhouses shall not apply.
  • Stacked townhouse dwellings (note e): RM3 regulations except front and street side yard setback 3 m to dwelling and 6 m to garage; yard abutting an RAL1, RAL2 or LN2 zone 12 m; maximum driveway width 3 m; landscape area abutting a street 3 m; on lots west of Walker's Line the garage width shall not exceed 50% of the front face of the dwelling and driveways shall not be wider than the garage.
  • Day care centre (note h): permitted only fronting on a street with a deemed width of 26 m or greater, subject to RAL1 detached dwelling regulations; no parking within 3 m of a residential property in a residential zone.
  • Additional residential units (note i): subject to Part 1, Section 2.21, Subsection (u).
  • General (Section 1): 'H' holding prefix defers permitted uses to Part 11 s.1.1-1.2; accessory buildings per Part 1 s.2.2; patios/decks s.2.3; fences s.2.4; swimming pools s.2.5; lands adjacent to Lake Ontario s.2.30; Part 14 exceptions apply.
  • Parking lots shall be set back 4.5 m from a street line (s.1(h)).
  • Driveways and parking lots for townhouses, stacked townhouses and apartment buildings up to 3 storeys set back 3 m from a wall with habitable-room windows (unless for the unit occupant's exclusive use); parking spaces set back 6 m from an R1, R2, R3, LN3, LN4, LN5 or LN6 zone (s.1(i)(i)).
  • For apartment buildings 4 storeys or more: driveways set back 9 m and parking spaces 6 m from a ground-floor or basement habitable-room window; driveways and parking spaces set back 6 m from an R1, R2, R3, LN3-LN6 zone (s.1(i)(ii)).
  • Enclosed parking structures more than 1.6 m above grade meet principal building yards; structures below grade up to 1.6 m above grade set back 3 m from a street line; no encroachment into a required landscape buffer abutting a residential zone (s.1(j)).
  • Prohibited (Section 2): parking/storing motor vehicles over 3000 kg GVW, 6 m long or 2.6 m high (except recreational vehicles); stake-body vehicles; recreational vehicles or utility trailers exceeding 3.6 m combined height; any vehicle, trailer, boat etc. within a landscaped open space area.
