A higher-density Orchard Community zone for townhouses, stacked townhouses, apartment buildings and retirement homes of 3 to 5 storeys, with small ground-floor shops and offices allowed as accessory uses.

Other provisions in this section

  • Other yards (Table 2.20.2): yard abutting a pipeline easement 6 m; yard abutting a railway right-of-way 30 m.
  • Accessory commercial uses permitted (s.20.2(a)): art gallery, convenience store, video rental store, drug store, florist, bank and trust companies, shoe repair, barber/beauty shop, dry cleaning depot, lodge/fraternity/private club, office, convenience/standard/fast food restaurant, outdoor patio (subject to Part 1 s.2.21(v)), duplication/reproduction services, computer sales and service, athletic or fitness club, auditorium, social organizations.
  • Accessory uses: maximum 300 m² floor area per accessory use (s.20.2(b)); floor area ratio 0.15:1 maximum for all accessory uses excluding office and restaurant uses (s.20.2(c)); accessory uses must be on the ground floor and below-grade floors only, except offices may also be on the second floor (s.20.2(d)).
  • Attached garage must keep the same or greater setback from the street line as the dwelling, or the same setback as an attached porch, and must not encroach into the required yard (s.20.5(a), (e)).
  • Detached garage in a rear yard abutting a public or private lane may be built to the rear lot line, set back 90 cm from a side lot line and 3 m from a side lot line abutting a street; a detached garage in a rear yard must be 6 m from a dwelling on the same lot (s.20.5(b)).
  • Minimum distance between exterior walls of two townhouse or stacked townhouse buildings: 4.5 m where facing walls have habitable-room windows, otherwise 2 m (s.20.5(c)).
  • Street Townhouse units on lots less than 7.65 m wide do not require grade-level access between front and rear yards (s.20.5(d)).
  • Minimum first-floor ceiling height for any building: 3 m (s.20.5(f)).
  • Encroachments (s.20.6): porches, stairs and canopies may encroach 3 m into a required rear yard and 2 m into a required front yard; on a street with deemed width 26 m or greater they may encroach into the front yard up to the street line (notwithstanding Part 1 s.2.13).
  • Landscape buffer of 3 m where a Townhouse, Stacked Townhouse, Apartment Building or Retirement Home abuts any other residential use (s.20.8).
  • Amenity area for stacked townhouses and apartment dwellings: 25 m² per bedroom in a unit; 15 m² per efficiency unit (s.20.9).
  • Laneways: a public street abutting the rear yard of a through lot is considered a public lane (s.20.11).
  • Holding 'H' prefix: uses per Part 11 s.1.1; development deemed premature until 'H' removed per Part 11 s.1.2 (Part 2 s.1(a)).
  • General provisions (Part 2 s.1): accessory buildings per Part 1 s.2.2; patios and decks s.2.3; fencing and privacy screens s.2.4; swimming pools s.2.5; lands adjacent to Lake Ontario and Burlington Bay s.2.30; parking lots set back 4.5 m from a street line; for townhouses, stacked townhouses and apartments up to 3 storeys, driveways and parking lots set back 3 m from a wall with habitable-room windows (not applicable to a unit's exclusive space) and parking spaces 6 m from an R1, R2, R3, LN3-LN6 zone; for apartments 4+ storeys, driveways 9 m and parking spaces 6 m from ground-floor/basement habitable-room windows, and 6 m from an R1, R2, R3, LN3-LN6 zone.
  • Parking structures (Part 2 s.1(j)): enclosed structure more than 1.6 m above grade subject to principal building yards; below grade and up to 1.6 m above grade set back 3 m from a street line; must not encroach into a required landscape buffer abutting a residential zone.
  • Prohibited (Part 2 s.2, plus Part 1 s.2.22): parking/storing a motor vehicle over 3000 kg registered GVW, 6 m length or 2.6 m height (recreational vehicles excepted); stake-body vehicles; recreational vehicles or utility trailers exceeding 3.6 m combined height; and any vehicle, trailer, boat or similar conveyance within a landscaped open space area.
