By-law 2020 Part 2, Sections 1-2, 7 and 9 (Table 2.7.1; Tables 2.9.1 and 2.9.2) of the City of Burlington Zoning By-law 09-2026 / 2020.

A medium-density residential zone mainly for fourplexes and townhouse developments (plus retirement homes), where detached, semi-detached, duplex and triplex dwellings are also allowed but must follow the lower-density R3.4 or RM1 zone rules.

  • Other yards (Table 2.9.2): building setback abutting a creek block 7.5 m, or 4.5 m if the block includes a 3 m buffer; yard abutting a pipeline easement 7 m; yard abutting a railway right-of-way 30 m.
  • Landscape area (s.9.2): 4.5 m abutting a street with a deemed width up to 26 m; 6 m abutting a street with a deemed width greater than 26 m.
  • Landscape buffer (s.9.2): 6 m abutting R1, R2, R3, LN3, LN4, LN5 or LN6 zones.
  • Parking (s.9.3): provided in accordance with Part 1, Subsection 2.25 Off-Street Parking and Loading Requirements.
  • Parking lots shall be set back 4.5 m from a street line (s.1(h)).
  • For townhouses, back-to-back townhouses, stacked townhouses, cluster homes and apartment buildings up to 3 storeys, driveways and parking lots set back 3 m from a building wall containing habitable room windows, except where the parking space and driveway is for the exclusive use of the unit occupant; parking spaces set back at least 6 m from an R1, R2, R3, LN3, LN4, LN5, LN6 zone (s.1(i)(i)).
  • For apartment buildings 4 storeys or more, driveways set back 9 m and parking spaces 6 m from a ground floor or basement habitable room window; driveways and parking spaces set back 6 m from an R1, R2, R3, LN3-LN6 zone (s.1(i)(ii)).
  • Enclosed parking structure extending more than 1.6 m above finished grade is subject to the same yard requirements as a principal building; below grade and up to 1.6 m above grade, set back 3 m from a street line; must not encroach into a required landscape buffer abutting a residential zone (s.1(j)).
  • 'L' shape detached dwelling without attached garage/carport forming one side and one end of a 4.5 m x 6.5 m parking space: required side yard is that of a detached dwelling with an attached garage or carport (s.1(g)).
  • Holding 'H' prefix: uses per Part 11, Subsection 1.1; development deemed premature until the 'H' is removed per Part 11, Subsection 1.2 (s.1(a)).
  • Accessory buildings/structures, patios and decks, fencing and privacy screens, swimming pools, and lands adjacent to Lake Ontario/Burlington Bay: refer to Part 1, Subsections 2.2, 2.3, 2.4, 2.5 and 2.30 respectively (s.1(b)-(f)).
  • Prohibited (s.2, plus Part 1 s.2.22): parking/storing a motor vehicle (other than a recreational vehicle) over 3000 kg registered gross vehicle weight, 6 m length or 2.6 m height; any vehicle with a stake body; a recreational vehicle or utility trailer with load exceeding a combined height of 3.6 m; and any vehicle, trailer, boat or similar conveyance within a landscaped open space area.
  • Street townhouse, back-to-back townhouse, stacked townhouse and apartment buildings are not permitted in RM2 (Table 2.7.1).
